We worked really hard last year on all sorts of things, but one publication that I’m really pleased to see has finally been published is the chapter that we wrote for the online resource the Copyright Cortex on Copyright and Digital Cultural Heritage: Licences and Licensing Agreements. Professor Ronan Deazley is behind the Copyright Cortex which was launched in 2017 and the resource is still being added to. The Copyright Cortex is an online resource dedicated to copyright and digital cultural heritage. It was developed to provide libraries, archives, museums and other memory institutions with information and expert commentary on how copyright law affects the creation and management of digital cultural heritage. The resource is also be valuable for anyone who works in the Digital Humanities. Ronan was our keynote at last year’s Icepops conference. Here he is offering up a plate of delicious cakes!
In our chapter we provide you with an overview of licences and licensing agreements, including what they are, how they relate to copyright exceptions and crucially how they relate to the work of information professionals and others in the cultural heritage sector. We discuss a variety of licence types, including e-resource licences, open licences as well as collective licences available to the sector. We also briefly look at the relationship between copyright and contract law. We finish by reviewing the new provisions in UK law which allow Collective Management Organisations (CMOs) to offer Extended Collective Licensing (ECL) schemes, and how this might increase access to difficult-to-find works, such as those that are out of commerce.
In summary, licences play an important role in providing access to copyright works but are not always available or appropriate. We’re particularly interested in the relationship between licences and copyright exceptions in cultural heritage and educational contexts, which is an important part of Copyright the Card Game.
